Student Loans: Nitty Gritty Nuts & Bolts
The panel will provide an update on new decisions regarding bankruptcy discharges, provide forms and materials to help you assist your eligible client in obtaining a bankruptcy discharge, and how to get paid. The panel will discuss the new trend of redefining a “student loan” and narrowly reading Section 524(a)(8) to argue for discharge. We will also discuss non-discharge remedies for your clients through the use of chapter 13 plans to get your client’s current on payments and work out a loan modification. The panel will also discuss the new rules that went into effect on 10/16/18 and how to assist your clients in discharging their student loans outside of bankruptcy. In addition, the panel will discuss how to identify which type of student loan is at issue and the particular non-bankruptcy rules for each.

Why you should attend:

You want to stay on top of the current student loan caselaw and alternative non-discharge methods to assist your clients with their student loans. The panel will provide practical guidance on these subjects along with forms and briefs you can use in your practice.

How You Can Evolve Into a Tech-Savvy Law Firm
In Clio’s recent Legal Trends Report, lawyers only spend an average of 2.4 hours out of an 8-hour day on billable work, with daily administrative tasks and new client development making up the bulk of the remaining 5.6 hours per day.  While they are able to piece together processes and systems to keep the firm running, they often lack basic technology to make the operations run smoothly.  Many law firms are still using outdated methods like printing all documentation, maintaining physical files on each client, mailing individually prepared invoices, and keeping separate document management systems.  How can law firms spend more time practicing the law instead of managing administrative tasks?
Attend our session, as we discuss how you can effectively leverage technology to streamline tasks and optimize your entire business. Learn how you can better manage your firm’s back office operations and gain new visibility into your finances and business performance.

David Windecher is a defense attorney in Atlanta, GA. He is an author, television star from CBS’s “Hunted” and founder of RED, a non-profit dedicated to ending recidivism. He represents clients facing major felony and misdemeanor charges. David will share his life story which he wrote in the book “The American Dream” – the story in which he portrays the difficulty of obtaining the American dream as an impoverished minority.
David grew up in the streets of Miami, and was first arrested at age 11 for shoplifting, stealing out of desperation to feed his family. For the next seven years, David was involved in a criminal lifestyle racked with violence, drugs, and money. He later joined a gang and was arrested over 13 times. Despite a life of crime, deep inside, David dreamed of becoming an attorney and fighting for justice for all. David’s faith in God and Love for his family were the catalyst for turning his life around.

Law and Lawyers in Nazi Germany
The eclipsing horror of the genocide committed by Nazi Germany between 1941 and 1945 can blind us to the facts that years of non-genocidal repressions preceded it and that lawyers were integral to the design and maintenance of the system.  This talk reviews the roles that lawyers played in the Third Reich and highlights the all-too-ordinary motivations behind the choices attorneys made.

Over the last five years, Richard Cordray served as the first-ever director of the Consumer Financial Protection Bureau, a position he was appointed to by President Obama, where he led an agency that was launched in the aftermath of the nation’s financial crisis, dedicated to defending families against Wall Street and corporate abuse. Under Cordray’s leadership, the CFPB brought actions against some of the nation’s largest financial institutions – forcing them to pay nearly $12 billion to over 30 million Americans who were cheated or mistreated. Cordray also launched new programs to help Americans and their families reach their own financial goals and plan for retirement.

Chapter 11

The panelists are excellent.  They have put together really good and practical materials.

How do you determine if a client should be in chapter 11 or chapter 13?

Can this client make it through a chapter 11 case?  What are some markers you can use?

Figuring out the exit strategy before you enter chapter 11.

Which first day motions should you file?

What is a disclosure statement?  What are common errors attorneys make when preparing them?

How can you get a plan confirmed?

What do you do once the plan is confirmed?

What are some things attorneys do which kill chapter 11 cases?  Why do I have to get employed by the judge?  What if I skip this step? I'll still get paid, won't I?

The panelists are highly experienced and highly opinionated.  If you are a newbe, you will walk out of the program with a good understanding of what it takes to hanle a chapter 11 case.  If you are an experienced attorney, the panelists will give you  good nuggets to help you in your practice.

ACLU – Pound of Flesh – The Criminalization of Private Debt
This presentation will discuss the disturbing trend of how the collection of private debt has resulted in incarceration of debtors. It will cover the main findings from ACLU Principal Human Rights Researcher Jennifer Turner's report A Pound of Flesh: The Criminalization of Private Debt, which investigates debt collection in 26 states. We describe the public policies and court practices that allow the arrest and jailing of debtors and the consequences of these legal interactions on debtors. We conclude with policy recommendations that protect debtors' due process, equal protection, and human rights.
