Student Loans: Nitty Gritty Nuts & Bolts
The panel will provide an update on new decisions regarding bankruptcy discharges, provide forms and materials to help you assist your eligible client in obtaining a bankruptcy discharge, and how to get paid. The panel will discuss the new trend of redefining a “student loan” and narrowly reading Section 524(a)(8) to argue for discharge. We will also discuss non-discharge remedies for your clients through the use of chapter 13 plans to get your client’s current on payments and work out a loan modification. The panel will also discuss the new rules that went into effect on 10/16/18 and how to assist your clients in discharging their student loans outside of bankruptcy. In addition, the panel will discuss how to identify which type of student loan is at issue and the particular non-bankruptcy rules for each.

David grew up in the streets of Miami, and was first arrested at age 11 for shoplifting, stealing out of desperation to feed his family. For the next seven years, David was involved in a criminal lifestyle racked with violence, drugs, and money. He later joined a gang and was arrested over 13 times. This will be an intensive review of the means test led by Judge Rodriguez of the Southern District of Texas.  There will be hands on materials to review and discuss concerning expenses to be listed on the means test.
